Filing for Short Term Disability
Hello,
I am a newly disabled worker. I am located in California where we have a state sponsored Short Term Disability plan. I also have a employer sponsored Short Term Disability plan that I can also use. My question is two-fold: Can I draw both plans at the same time or can I use on plan and when it runs out switch to the other plan? Also, is there a penalty for future credit and insurance purposes for filing a claim with a private insurance carriers Short term plan?

The devil is in the details. Insurance is contract law. See if your employers sponsored plan will pay benefits regardless of state coverage, will it pay up to the maximum percentage of payroll allowed, or the policy limits. Most disability contracts are written so a disabled party cannot receive more than 60 or 70% of income. Otherwise everyone could purchase multiple policies, and find any reason to falsify a claim.
