Is it appropriate for an employee to post on the wall of a common space (the lobby) a petition against same-sex marriage?

This person also posts political posters and covers her personal workspace with literature expressing her strong views. What recourse do I have?

No appropriate - does your company or the building management have any rules about posting non-work related issues on common space. I would talk to your hr department or senior management about it. The company could develop - if they don't have already - company guidelines about posting materials.

Hi Lisbeth,

A situation such as this is best handled through implementing or updating the company policy regarding unapproved postings as well as respectful work environments. The common space is an easy fix, and while the employee may think their cubicle or desk area is their own space, it is in fact the company's property. I would suggest implementing two policies if they do not exist. One which addresses unauthorized or unapproved postings in common spaces as well as one which addresses fostering a respectful work environment.

Given that you mention the postings are strong in nature, it sounds as if they may go beyond the simple "I support xyz candidate". A respectful work environment policy can address any derogatory or offensive comments, behaviors, and postings. Such a policy can be included in your current anti-discrimination, zero-tolerance or harassment prevention policy, if such exist. A section of the policy can specifically address expression of political views (what is acceptable and what is not) and indicate expressions which violate current policies regarding inappropriate behaviors and/or references to gender, race, ethnicity, sexual orientation, religion, etc. will not be tolerated. However, as Stephen mentioned, these will need to be across the board policies which are enforced. Also, be sure to have any policies which are drafted reviewed by your attorney before they are finalized and communicated.

Hope this helps.

Best regards,
Treivor
