What is the process for business incorporation?

I am starting a business and am wondering about where to start the process of business incorporation? How do I know which structure to file as (LLC, Corporation, Partnership, etc.)? What resources do you suggest for someone going along this path?

While there are countless resources available online, I wouldn't discount speaking with an attorney before you make your decision. Based on my own research, if it had been up to me, I'd have incorporated as an S corp. I ultimately incorporated as a C Corp based on the advise of my attorney (I was surprised!) There were tax and other liability implications pertinent to my business that would have been nearly impossible for me to have discovered on my own. Consider working with an attorney or tax accountant, or both, after you've learned the essentials about the various business structures.

Having worked with hundreds of startups, I would second that notion. There are some great legal blogs that spell out the step by steps plans. One that I point people to is http://danashultz.com/blog. Dana does excellent content for startups.
